Gaston Duzac could be paying the debt with COFIEC

The deadline for the citizen Gaston Duzac to return the 800,000 dollars he paid COFIEC Bank, in December 2011, could not be paid. The representative of Duzac, the attorney Julio Plaza Rada, said his client only returned $ 90.000 in two payments.

“If that does not happen they will have to run the guarantees provided by the Agricola de la Mercedes,” said Plaza Rada. According to him, this would be the solution adding that “although COFIEC belongs to the trust (AGD No more impunity), is a private bank, the trust is not of the state, it has a purpose and a constitution.” Furthermore he indicated that other companies (Agricola de las Mercedes and Rocafuerte Insurance) “will have to see how they did it and why they did it and if they have to pay they will pay.”

Meanwhile, Assemblyman Andres Paez, who does not share those views, said that “the state can not execute itself on the guarantee in this case.” Yesterday he went to give his version without the attorney oath in open inquiry to investigate the case.

Besides giving his testimony in the record, Paez read the versions of other persons called by the prosecution. The lawmaker added that he could not “understand how the prosecutor has not asked for the arrest of Diana Macancela so that from prison she can be accountable for her actions.” According to Paez, Macancela was the one that allowed the delivery of the credit to Duzac “ deliberately hiding information to the COFIEC bank directory“.

Finally Paez criticized the prosecutor’s performance, Galo Chiriboga, who questioned “why with so much evidence is allowing this case to be led inexorably to impunity for the lack of action by the Prosecutor.” He referred to the evidence he gave to the prosecution, which demonstrates how the meetings of the Credit Committee of COFIEC omitted requirements and allowed the money to be paid to Duzac.
