The CAL calls Gustavo Jalkh to explain the ‘inexcusable error.’

President of the Judicial Council Gustavo Jalkh will be summoned by the Commission of Justice to explain the processes of sanction of judges who committed the ‘inexcusable error.’
The decision was taken by the Legislative Council of Administration (CAL), after the request submitted by Luis Fernando Torres (PSC-Cambio Party). The appearance is scheduled for next Wednesday.
Articles 109 and 131 of the Organic Code of Judicial Function, describe the inexcusable error as a grave fault that provides for the dismissal of the judicial servers.
Legislator Patricio Donoso (CREO) commented that Jalkh’s presence in the Legislature is required to explain the removal of many judges through the application of this legal concept.
“The legislators want to know who rules, how he does,” Donoso added.
Esteban Bernal, who is also a member of the Justice Commission, yesterday ratified his intention to impeach Jalhk for his alleged interference in the administration of justice.
As an example, Bernal recounted the case of a lawsuit filed in Cuenca by the citizen Édgar Ugalde against the State in September 2010 for having authorized the departure abroad of his minor daughter without his consenting. Jalkh was Minister of the Interior by then.
The judges ruled in 2014 in favor of Ugalde and ordered the state to pay $ 270 thousand as compensation.
Bernal argued that the judges who sentenced against the state were removed for inexcusable error; Jalkh was president of the Judicial Council when this happened, although he was a defendant at the beginning of the trial. (I)
