Supercom will submit a draft reform on the LOC
The Superintendency of Information and Communication (Supercom) will submit next October 15 a draft reform to the Organic Communications Law (LOC for its Spanish acronym) that has 119 articles and 24 transitory provisions. The approach was made based in the the experiences of the first year of this standard.
The holder of this entity, Carlos Ochoa, insisted that the reforms are based on observations of its application.
In the draft is intended that penalties are proportional. For example, he criticized the media lynching, which can end the life and honor of a person, is only sanctioned with a public apology. For the Superintendent “there is no proportionality between the fault and the penalty on the media”. He also said that there are medias, which despite of apologizing, generate the same negative behavior on successive occasions and it must exist a higher penalty.
Moreover, it is discussed the possibility of adding to their faculties the capacity of coercives in the resolutions issued against the media when there is non-compliance .
