He is a harsh critic of the current government. For this legal expert from Guayaquil, reforming the structure of the state will be an obligation of the next government.
– Is it possible to convene a Constituent Assembly as announced by the opposition?
– It is the only possible way to dismantle the correism.
– Why?
– All the consultations require the permission of the Constitutional Court, minus one: a call for a Constituent Assembly.
– What would be the process?
– According to the Constitution, the president must annex the electoral rules to the call. These rules order that he has to do two things: first, a section that exempts the call from the Court’s opinion. For example, the Court will give its favorable opinion within 24 hours and if it does not, it will be deemed granted.
– And the second?
– The president, in the second section, suspends the exercise of all government authorities by virtue of the fact that the Constituent Assembly will be convened and he will have to confirm or reject the period for which they were elected.
– Are we talking about the supervisory authorities?
– Yes, control bodies, of administrative regulation, of the Public Prosecutor’s Office etc.
– Is the President able to decide for himself that these authorities remain in office?
– He cannot dismiss them, for the same reason it is not possible to ask people, in a referendum, if they agree that these authorities leave office.
