The bank must return money for undue charges, with interest

The problem of undue collections through the institutions of the financial system came to the Board of Monetary and Financial Policy and Regulation.

In a press release, released on, October 30, 2018, the agency reported that since October 26, 2018 passed Resolution 463 that establishes that financial institutions have a period of 30 days to verify the existence of documents or proof of debit authorizations, in the cases of claim.

When there are no such authorizations, the financial entities will proceed to make refunds on the amount of the claim, plus the interest caused, calculated from the date on which the debits or charges object of the claim occurred up to the date of total refund, at the rate of legal interest published by the Central Bank of Ecuador and in force at the date of payment.

To facilitate the claims of customers, partners or users, financial institutions must enable all physical or technological channels that they require, including specific telephone lines, access to web pages or the indications in the account statements. To comply, the entities have a 30-day term. (I)
