Assemblyman Clever Jimenez filed his appeal to the judgment

Defense attorneys of the Assemblyman Clever Jimenez and activists Fernando Villavicencio and Carlos Figueroa, presented last Friday, before the National Court of Justice, the applications for annulment and appeal to the judgment of Lucy Blacio, Judge of the Criminal Division.
This judgment was given in the trial that follows the Ecuadorian president, Rafael Correa, for alleged libel accusations and where Villavicencio and Jimenez were sentenced to a year and a half in prison, Figueroa only to six months and it includes a public apology and payment of $ 120,000 for compensation.
Julio Cesar Sarango attorney of the sentenced maintains that the process is void because, at its discretion, Blacio acted against Article 128 of the Constitution, which guarantees the immunity of the assemblymen. He explained that Article 494 of the Criminal Code requires that the “malice or recklessness” be approved in court.
So there was no prosecution. Therefore Jimenez, Villacencio and Figueroa ask that Judge Blacio be dismissed, said the defender. In case that the process is not declared invalid, the appeal is filed, so that a higher court knows about the case.
