Duzac attorney’s oppose to report of alleged calculation error
The defence Gaston Duzac, who received an irregular loan of $ 800,000 by the COFIEC Bank which still remains unpaid, was filed in the Civil Court 24, in a written statement that describes the error committed in its discretion to the expert report which fixed the amount of Duzac’s debt at $ 811 602.4, including the capital and interests.
COFIEC Bank belongs to the Management Unit of Public Law (Ugedep), whose representative back then was Pedro Delgado, now a fugitive on charges of misrepresentation.
According to Julio Plaza Rada, Duzac’s attorney, a mistake was crucial because the settlement was based on a year with 360 days. “Therefore, the calculation is not accurate as I will show in due course the process established in Article 1258 of the Civil Procedure Code,” said Plaza.
Plaza said that the expert Leticia Morales Galecos had to consider the amount of days a year at the time of the calculation, because 2012 was a leap year and should be 366 days.
Meanwhile Fabricio Segovia, 24 Civil Judge, ordered by request COFIEC Bank, to set the total amount of the debt, after knowing the exact amount, to perform a forced recovery, in which the judge asked that Duzac pay or resign on that value goods within three business days.
