Inspection Commission would not call President Lenin Moreno in case INA

The Australian founded the WikiLeaks portal, which in the last days broadcast press releases and images of the private life of President Lenin Moreno. The leaks made by WikiLeaks on electronic communications of President Lenin Moreno will motivate legal actions, on the international level, against the directors of said website, according to the chancellor of Ecuador, José Valencia.
The lawsuit could include the founder of the portal, Julian Assange, who has been asylum in the Ecuadorian embassy in London (England) since 2012. These leaks contain alleged statements from the President stating that he tried to “sell” to the United States the custody of Assange, as well as images of the private life of the Moreno-González family.
In addition to external legal actions, the Office of the Prosecutor may initiate an ex officio investigation for the dissemination of private images of Moreno’s family, which is considered a violation of privacy according to the Organic Comprehensive Criminal Code (COIP).
Article 178 states that the person who, without having the consent or legal authorization, access, intercept, examine, retain, record, reproduce, disseminate or publish personal data, data messages, voice, audio and video, postal objects, Information contained in computer media, private communications or reserved by another person by any means, will be sanctioned with imprisonment of one to three years.
The president of the Bar Association of Pichincha, Ramiro Garcia, said that any person, whether Ecuadorian or foreign, if he commits a crime should be investigated by the Prosecutor’s Office. He mentioned that although Julian Assange does not run WikiLeaks several years ago, it is clear that every time there is a problem because he does not want to comply with the protocols of the embassy, these leaks arise.
In addition, Article 190 of the COIP also criminalizes the illegal appropriation by electronic means, and in 230, the crime of interception of data. The director of international studies at the Universidad Andina, Michel Levi, pointed out that the only solution to Assange’s problem in the embassy is to ask him to leave, although he cannot be forced because, in addition to being a political refugee, he is an Ecuadorian citizen. But in the case of a criminal investigation, he said, the Prosecutor’s Office can demand that it be presented for trial in Ecuadorian territory. (I)
