Jairala Defense appealed to judgment
The Defense of the Prefect of Guayas, Jimmy Jairala (AP-Democratic Center), yesterday presented an appeal to the court, which declared the National President of CREO, Cesar Monge, not guilty of the crime of libel.
Judge Djalma Blum argued that the crime by which Monge is accused no longer exists since the entry into force of the new Penal Integral Code (COIP for its Spanish acronym), in last August.
Jairala on the judgement said: “There are unusual things, for example, if you want to defend your honor you have to be a public worker, and if you are no longer that, you can no longer defend yourself. And the honor of a person is subordinate to the outcome of an election: the Judge says that as I won, there is no objectively injury to my honor.”
He further explained that this judgment is of first instance, so that his appeal will go through a criminal court and, if applicable, to the National Court of Justice for a review.
