This Thursday, September 20, 2018, Juan Pablo Albán finished his duties as member of the Council of the Judiciary (CJ) transitional, as an assignment of the Council of Citizen Participation (Cpccs-t). He leaves the position for academic commitments previously acquired.
This afternoon, the lawyer gave a press conference as an accountability. Next to him was Angelica Porras, also a vocalist, with whom they formed a kind of minority within the transitional CJ. There Albán said that he accepted the position with the aim of establishing a vision of judicial independence. And for this he tried to set up padlocks in the system to ensure that the operation of justice is transparent and independent.
In addition, at the initiative of Porras, he said, they tried to make visible the abuses of the past and proposals were generated to demonstrate that the judicial system was used as a system of abuse of rights and in the plenary session they were unanimously welcomed.
On the evaluation of the National Court of Justice (CNJ) indicated that this was an idea of Porras and, therefore, the Plenary of the Judiciary ordered her to build the parameters that should be used for that process. And he added that although those standards were not discussed and approved, he hopes that the final CJ that will make the evaluation can take them into account. “It is necessary to recover credibility in the justice system. For this, it is necessary to evaluate the National Court. I hope that the final CJ takes into account the methodology proposed by the vocalist Angélica Porras, “he said.
In his public appearance as a former councilor, Albán spoke of ‘listening’ equipment that he would have noticed in the Judicial Council. “I was able to verify with information provided by officials of the Judicial Council itself that, in fact, there are camera systems here. There are microphones in the elevators that are activated after certain hours and the Judicial Council has on its property listening equipment telephone despite the fact that the only authorized entity, according to the law to listen, is the Prosecutor’s Office and prior judicial authorization. ” Albán continued: “Those equipment’s were not acquired by the Council of the Transitory Judiciary, obviously not, those equipment were already here, the cameras, the microphones in the elevators, the telephone recording equipment were already here. The the intention was to be able to monitor the activity of the judges, if it was so serious. ” Referring to the criticisms that the Judicial Council has received, he said that those who want to judge them by a 45-second recording, do not really understand the difficulty of the work and what the five vowels have done.
He added that the five had a common goal, with different methods: to improve the Justice of the country. This in reference to a recording that was leaked on social networks, corresponding to a session of the Plenary of the CJ, in which Albán is heard discussing shouting about the investigation to Juan Vizueta, with the vocal Achilles Rigail.
Albán hopes that the work that the transitory Judiciary did and continues to do will be taken into account by the definitive Council. “We cannot re-found the country every 10 years, we cannot elect a new high priest to take care of the head of those we want to remove. The people are passengers and the institutions are permanent. We cannot every time new authorities are named re-found institutions, “he said.
Although Albán officially leaves the Council of the Judicature, he announced that Marcelo Merlo, president of the entity, asked him to continue as an external consultant and that he has accepted, but that he will not receive payment for that function. When asked again about his complaint about the system of cameras and microphones in the facilities of the Judiciary, he did not answer any more questions on the subject because he said he was traveling this Thursday night to the United States, and had several pending related to that displacement.
