Proposal of doctors to the COIP was sent to the CNJ
The Council of the Judiciary (CJ) sent the interpretive proposal made by doctors to clarify the Article 146 of the Criminal (COIP), to the National Court of Justice (CNJ) and according to sources of the court, a pronouncement would be ready within four weeks.
On Wednesday, Gustavo Jalkh, chairman of the Judicature submitted the documents prepared by the guild of doctors and the elaborated by the students of the Central University of Ecuador.
Jalkh said the text interpretation in the third paragraph of Article 146 of the COIP seeks “to confirm, that the third paragraph is not read separately from the whole context, it was agreed that this will be given and this ratification form a part of an interpretation of the Court. ”
In this context, he stated that it should be two electives situations to eliminate: the one that it can produce impunity and that the citizenry has no right to exist against professional responsibilities, and the other one that can lead to exaggerated penalties.
Even if it must be applied in six months, with the publication of the COIP in the Official Register (RO,) the standard is in effect, stressed Jalkh. Meanwhile, Hugo del Pozo, director of the RO said the Special Supplement of the new law will be published the following Monday.
