The Drugs Law
The Draft Organic Law for Integral Prevention of the Socio economic phenomenon of Drugs and Regulation and Control of the Use of Substances Subject to Control is the pompous name of an organic law of vital importance for the Ecuadorian society, that´s why it calls attention the speed with which this project has been processed.
This project, along with the Communications Law is one of the few projects of organic law that has not been prepared and submitted by the executive branch, Assemblyman of Alianza Pais for Carchi, Carlos Velasco, William Garzón, for Santo Domingo de los Tsáchilas, both doctors, are the authors of this bill. Since this is an issue that involves several important ministries of the presidential cabinet, a technical secretariat attached to the presidency was created.
Bayron Pacheco, Assemblyman of the Avanza party and member of the special commission of the Right to Health that processes the bill, when asked in the program Contacto Directo about if the presidency has sent technical reports or opinions of the case on the various aspects comprised in the law, said: “in the commission of the Right to Health we have socialized this issue, we have discussed with the assembly members, we have invited delegates of the Consep, we have heard and met the requirements and approaches of the medical and scientific society, we’ve heard representatives of civil society, and we as legislators have stated our views. This subject is too broad and highly sensitive for the Ecuadorian society.”
The drug problem is infinitely complex and delicate, it has brought to its knees entire countries like Colombia and Mexico, attention to this bill is due to the explosion of micro-trafficking for domestic consumption, but there are plenty of situations that are not addressed in the bill, penalties against micro-traffickers are toughened but the big capos are untouchable, there is nothing about the planes that violate the airspace and traffic drugs, there are many confusing situations in this law.
“All attempts that this government or any government in the world have made against drug trafficking will never be sufficient, the fight against drugs is a state policy that should go hand in hand with the civil society, this bill is necessary because the drug is commercialized in schools,” said Pacheco.
The new chart decriminalize the consumer, and there is also a chart that penalizes micro-traffickers. Penalties have been toughened for those who have drugs in their possession, without ignoring the public health problem that represent the drug addicts.
