The IRS acted illegally in “La Clementina”

Sylka Sánchez
Exporter Bananera Noboa’s attorney, Sylka Sanchez, rejected the notification of the seizure of the property “La Clementina” held yesterday morning by the Internal Revenue Service (IRS).
It is an action for withholding credits, which could have employment implications, failure to honor obligations and other commitments that could lead the company to bankruptcy and consequent devaluation, said the attorney.
She also said that the SRI procedure is null and void, illegal and illegitimate, due to the existence, in the District Tax Court, an exception lawsuit raised by Banana Noboa which suspends the execution of the coercive process as provided by the law in Article 214 of the tax Code, lawsuit that is pending resolution, and also they acted in an irrational and intimidating way, using the armed forces, the police and tax officials, in another act of this political media show, which is now common to the SRI.
Sanchez added that Bananera Noboa reserves the right to take international legal actions against officials who are acting against the law.
The attorney insisted ion the request for the intervention of President of the Republic, Rafael Correa, as mediator, in order to technically demonstrate the illegality of the gloss and thus close this unfortunate episode of abuse against Exporter Bananera Noboa.
