Investigation on case Balda includes people with court jurisdiction

The State Attorney General, Paul Perez, referred to the kidnapping of Fernando Balda in Colombia and said that in the case has been identified people who enjoy jurisdiction of National Court and possibly have a stake in the commitment of the crime.

The case is in a procedural moment of fiscal instruction, Perez said, stressing that the criminal process has begun against three police officers.

Police officers “who at some time swore to respect the Constitution and laws,  turns out that they ended up committing such a serious crime and that is considered internationally even as a crime against humanity,” said the Attorney General in an interview with a local channel.

“Logically, it is a crime of the State, as it has been cataloged, it is an emblematic case for the current administration,” Perez added.

He explained that he has even held meetings with Balda, who will have access to and knowledge of the investigative measures.

However, the official clarified that there are procedural institutions that by legal mandate must be kept secret and outside of judicial proceedings. He maintained that of the reserved information that the Prosecutor’s Office is receiving, “we are practicing the procedures that will allow us precisely to take the decision to prosecute and link the fiscal instruction to other persons who enjoy jurisdiction of the National Court”.

“The file is already in my office, has identified the existence of people who enjoy jurisdiction of National Court and possibly have a stake in the commission of this criminal act,” said Perez.

He also revealed that he has requested a special examination from the Office of the Comptroller General of the State, so that all expenses incurred in this case can be verified using public funds.

Finally, the Prosecutor indicated that this event which occurred on August 13, 2012, in Bogotá will have a “contudent response”. Balda accuses former President Rafael Correa of having given the order for his kidnapping. (I)
