The management company of the port of Guayaquil (Contecon), a subsidiary of the International Container Terminal, filed a complaint before the Superintendent of Control of Market Power against DP World (DPW) and Dubai World Corporation (DWC) for alleged unfair practices within the tender process of the deepwater port of Posorja.
DPW is negotiating an agreement with the Port Authority of Guayaquil (APG) for the granting of the construction and operation contract of the new port.
The lawsuit, filed on April 11, 2016, is processed by the intendancy of Unfair Practices, which will determine whether the Dubai company has fallen or not in such practices.
In addition, the Commission on Resolution of First Instance is hearing the case in order to assess whether or not the Contecon request of preventive measures is answered, so that the concession process is made more transparent, said yesterday Gilberto Gutierrez, attorney for the plaintiff.
