Government and doctors reach agreement over Article 146
Doctors and the government managed to reach an agreement last night about culpable homicide by professional malpractice, laid down in Article 146 of the Integral Criminal Code (COIP).
The proposal of an interpretative clause of clarification in the third paragraph of the article will be sent next week to the chairman of the Judicature Gustavo Jalkh. That does not involve the amendment of The Article.
With that clarification will be set that to implement the penalty of five years in prison for the aggravated offense, involving the death of the patient must concur with the four additional components that sets the item, besides the “unnecessary actions, dangerous and illegitimate “.
It is expected that this interpretation ends the fear of doctors to the COIP said the Health Minister Carina Vance.
