President Correa Announces agreements to modify criminal code

The President of the Republic, Rafael Correa, announced yesterday in his report to the nation that the Executive and the Assembly reached agreements on two controversial issues of the Organic Criminal Code (COIP) project that will be approved next week.
The wrongful death by malpractice, when it is unintentional, will have a 1-3 years prison sentence; but when the action is deliberate, dangerous, unnecessary and illegitimate, the penalty will increase from 3 to 5 years. The same article points out that the enabling process to exercise the profession after the penalty is fulfilled, “will be determined by the law”.
In the case of the issuance of sanctions for offending adolescents, there will be three levels of sanctions: those who commit a violation will be punished with community work; those who commit crimes punishable with less than 10 years in prison must meet four years of institutional confinement and educational measures; and those who commit offences punished with more than 10 years in prison will be punished with up to eight years of institutional confinement, two years of monitoring and a psychological examination six months before the end of the sentence.
