The resolution of political movement “PAIS” is now in court

The Contentious Electoral Court analyzes the decision that took part of the national directive, while the crossfire continues inside the political tent.
It has been 15 days since “ALIANZA PAIS” announced the separation of Lenin Moreno as president of the movement, but the situation is not fully defined, after a criminal court rendered the measure without effects.
In this scenario, now it is up to the Electoral Contentious Court to clarify the dispute that was born within “Alianza PAIS” and deepened the divisions between leaders and militants.
On October 31, the government’s political bureau rejected the decision; the next day the Court of Criminal Guarantees ordered that the National Electoral Council not to register the appointment of Ricardo Patiño, as the new president.
On November 13, Gabriela Rivadeneira, executive secretary, filed a complaint against the judges of Criminal Guarantees “for taking on functions that do not concern them, such as the electoral functions.”
In this space, Rivadeneira clarified that two thirds (22 out of 32 members) of the National Directorate voted affirmatively for the separation of Moreno
For “ALIANZA PAIS” the final decision was taken on October 31 and currently have a president in charge, Ricardo Patiño.
On the other hand, the Executive disagrees with the resolution. At the discretion of Miguel Carvajal, national secretary of Policy Management, that would have no place because it is up to the National Convention to make the decisions. Hence, each time, the proposal of a convention takes force, especially the wing related to the Government.
Mary Verduga, suspended 9 managers for the decision they made.. She was elected a member of the Ethics Commission on May 1, but according to Patiño and Rivadeneira, she was also separated on October 31.
Luis Fernando Molina, legal counsel of “Alianza PAIS”, explained that the decision taken by the National Directorate is not for “an act or alteration of principles in the exercise of their functions,” but for the absence of three consecutive meetings, referring to President Lenin Moreno.
Stated, this case did not need to go through the Ethics Commission and the decision was in application to the ninth general provision of the statute.
Verduga was also separated on October 31, Molina said that “all resolutions taken as coordinator of the Commission, are without effect,” such is the case of the suspension of several members of “ALIANZA PAIS”
Miguel Carvajal has said publicly that the bases of the movement and the provincial directorates have expressed their support for Lenin Moreno.
“The decision to remove from the National Presidency of @ 35PAIS the comrade @ Lenin is spurious and grossly arbitrary,” the official wrote on his Twitter account.
For the vice-president María Alejandra Vicuña, the decisions of “ALIANZA PAIS” were illegal and highlighted the decision of the Criminal Guarantees Court.
Molina indicated, however, that until October 31, Lenin Moreno had two qualities in the movement: as a permanent adherent, who has not lost it; and as president of the political organization.
“There was no talk of an alteration of principles in the exercise of their functions, but of the non-attendance and the legal effect that generates for the organization’s purposes is an accretion in the direction of “ALIANZA PAIS,” said Molina. (I)
