The Prosecutor, Carlos Baca, will request the maximum penalty for those involved in the death of the 10-year-old girl, who would have committed not only murder, but also rape and trafficking.

Baca announced that the Prosecutor’s Office filed charges against the three and will request the maximum penalty that in Ecuador may reach 40 years for the occurrence of crimes, according to the Organic Code of Comprehensive Criminal (COIP). “We are appalled by the case of Emilia and we are going to ask the judges for more severe penalties against those responsible.”
Additionally, he asked not to speculate and to wait for the course of the investigation. “Do not doubt that we will inform you at the opportune moment. We do not anticipate hypotheses, nor other potential participations.” The Office of the Prosecutor requested protection measures and psychological support for the relatives of the victim.
Pretrial detention
At the arraignment hearing held yesterday morning, Janet Pardo Montero, judge of the Criminal Judicial Unit of Loja, ordered preventive detention against José Fabián N.R., Manuel A.R. and Tania Yusibeth R.A.
He also ordered the prohibition of alienation of his assets and the freezing of his accounts. The stage of fiscal instruction will last 90 days and the process will be drawn in one of the prosecutors specialized in these crimes. The last person arrested is Tania Yusibeth R.A. (Transsexual), who was located at 20:00 this Tuesday at an address in Catamayo. She and the other two apprehended were transferred to the Social Rehabilitation Center of Loja. According to information from the National Directorate of Crimes against Life, Violent Deaths, Kidnappings, Extortions and Disappearances of Persons (Dinased), José N. was the one who did not allow Emilia to return home after school.
The citizen confessed that he victimized her, dismembered her and then incinerated her in a ravine near the entrance to Chuquiribamba. A forensic anthropologist who traveled from Quito to Loja analyzed the body of the victim to determine the causes of death, which was complicated by the state in which she was.
José Fabián appeared walking with the girl in the videos captured by security cameras that focused on the exteriors of private commercial premises. On the other hand Manuel A. allegedly used the taxi in which he worked to transfer the child. In the case of Tania, until the closing of this edition, her participation was unknown
