Civil Registry denies same-sex marriage

The Civil Registry  reported yesterday to Pamela Troya and Gabriela Correa about the denial of their civil marriage that they tried to carry out last Monday after having lived together for two years.

“The request of marriage of the couple was received and after the respective analysis, the Civil Registry requests the petitioners, that,  to continue with the procedure, prior to the celebration of the civil marriage, they must complete the requirements provided in the Constitution and the Civil Code,” said the Agency.

“Marriage is the union between man and woman, it will be based on  free consent of the intending spouses  and the equality of rights, obligations and legal capacity,” says the Constitution in its article 67.

For its part, article 81 of the Civil Code states that: “marriage is a solemn contract by which a man and a woman come together in order to live together, to procreate and to help each other”.

After making their request for marriage, the couple said that they did not expect a positive response from the organism, therefore they announced that they will present a protective action before a judge, then, if it is rejected, before the provincial court and ultimately to the Constitutional Court.
