Argentina’s Supreme Court Allows Abortion in Cases of Rape
Yesterday, Argentinean Supreme Court, with the unanimous vote of its seven members, approved abortion for rape victims, without having to resort to a judicial process.
This resolution changes the usual mode in Argentina, were abortions were only performed in rape victims with mental disorders or in cases of violations that have judicial authorization.
On the reluctance of professionals to interrupt a pregnancy in cases of rape, the ruling explains that physicians should not require judicial authorization to perform abortions, and should practice them requiring only the sworn declaration of the victim or his legal representative which confirms that the pregnancy resulted from rape.”
However, Ricardo Lorenzetti, president of the Supreme Court warned that the ruling “is not opening any doors” for the decriminalization of abortion and said that “its not promoting” abortion, but the statement is brought into line with the international law and that “no longer prosecute.”
