Court rules against evictions and eviction law in Spain
Yesterday the European Court of Justice ruled against the Spanish law of eviction for non-payment of mortgages, causing hundreds of thousands of evictions in the last four years, saying it’s illegal and violates the laws of the European Union (EU) on the consumer protection.
Alberto Ruiz-Gallardon, Spanish Minister of Justice, assured yesterday that the government will reform law evictions and mortgage to suit European law after the Court of Justice of the European Union.
The opinion declared by the Luxembourg court will force Spain to amend the law and judges that handle evictions should proceed accordingly. The Community institution based in Luxembourg believes the Spanish procedural rules affecting consumer protection, since the European directive had unfair terms in contracts.
