Attorney General Seletion Commission Asked to Keep Investigations on Hold
Posted On 27 May 2011
Following the departure of the Attorney General Washington Pesantez, Ulbio Guadalupe, president and member of the Selection Citizens Commission (CCS) asked the Prosecutor to file the call made to them to testify in the preliminary investigation opened for them for an alleged crime of malfeasance.
They argue that the notice of the prosecutor, Gustavo Benítez, is contrary to the Constitution and Organic Law of the Council of Citizen Participation and Social Control, which gives them the ability to elect the new authority of the Office .
The invitation to give a statement in the complaint filed by Elsa Moreno, aspiring to succeed Washington Pesántez in office, is an interference in the tender that has not finished and is in process. This is contrary to Article 28 paragraph 7 of the Standing Selection Citizen Commitee, which mandates that commissioners must keep in reserve the process information and not to deliver the reports in each phase.
According to Guadalupe, the commissioners have no problem whatsoever to testify once the entire process of selection is completed.
Similarly, Maria Paula Romo, Assembly woman for Ruptura de los 25 movement, announced she will object the participation of Elsa Moreno and Antonio Gagliardo in the contest, because they happen to be close associates of the outgoing General Attorney.
