Posted On 19 Mar 2014
Luis Fernando Torres, legislative of Cambio-CREO-PSC , the Legal Clinic of the San Francisco de Quito University and the Citizen Collective of the 60, presented yesterday for the second time his arguments at the hearing convened by judge María de el Carmen Maldonado, to claim the unconstitutionality of the Law of Communication.
The defendants were Alexis Mera, from the Presidency; Francis Abad, from the Assembly; and Jimmy Carvajal, from the Attorney General.
According to the claimants, the legal procedures were violated and arbitrarily articles of the law were added and changed. They also defended freedom of expression, access to information, the reservation of the source, non-discrimination, and regretted the prior censorship. Finally, they rejected the competence and powers of the Supercom.
Form their part, representatives of the State defended themselves. Abad gave an account of the dates and calls of the Assembly to treat the law. And Mera emphasized the Government theory that communication is a public service. They called for the rejection of the demand.
Carlos Ochoa, head of the Supercom, for 15 minutes ran against the press, journalists and the claimants. The judge intervened on two occasions without being able to contain the Superintendent.
