Claro would have a second penalty, according to Superintendence of market
A report of the First Instance Commission on Resolution of the Superintendence of Control of Market Power (SCPM for its Spanish acronym) notes that Conecel, which operates under the Claro brand, could be penalized for the second time.
The Commission considers it should be imposed “the maximum penalties” contemplated in subparagraph a) of Article 79 of the Organic Law for the Regulation and Control of Market Power, ie “8% of the the total turnover of the company or an infringer economic operator in the exercise immediately before the imposition of the fine.”
According to Pedro Páez, Market Control Superintendent, the penalty is for noncompliance to the arrangement of withdrawing the exclusivity clauses, despite Claro said it had complied with the precautionary measures in 2013.
