CN Sentence will be Effective Tomorrow
The countdown for the National Brewery (CN) to pay $ 90.9 million due to unpaid profits to its former employees starts running tomorrow, after the ruling will enter in its final process today.
These measures, however, will not stop the time limits to be applied in this case which will expire at midnight next Monday, March 21, said President of the Third Criminal Chamber of Guayas, Robert Guevara Elizalde.
The judge informed the parties will be notified today about the Board’s decision. He explained that once the response reaches the legal boxes of the parties, the ruling will be effective and 48 hours later CN will have to make the deposit on behalf of the thousands of employees and former employees who complained.
Guevara explained that although time itself ends at midnight on Saturday (a working day to constitutional issues like this), “in fairness it will be given until Monday to fulfill the 48 hours”, since it is a private company not working on Saturdays, the judge said.
He further clarified that the decision (reported on Wednesday 9 March) orders payment of the capital value, it means $ 90’929.135, with no interests added in the capital value, as CN executives complain. The judge said that interesta will be charged as a penalty if the company fails within 48 hours .
