Judge Arturo Cabrera issued a resolution on December 6, in which he concluded that the case be referred to the substantiating judge, “so that the Plenary that delivered the sentence in the second instance, made up of judges Patricia Guaicha Rivera, Ángel Torres Maldonado, Joaquín Viteri Llanga, Guillermo Ortega Caicedo and Patricio Maldonado Benítez, – by virtue of the corresponding analyzes – adopt the decisions it deems pertinent regarding the reparation measures issued by them.
These reparation measures, issued on October 30, consist in its substantial part that the National Electoral Council (CNE) executes “all necessary and pertinent administrative measures so that the Social Justice bodies and their legal representatives at the national, provincial level and foreign constituencies have reasonable time and adequate means, under the same conditions as the other political organizations, to carry out acts of internal democracy, registration and qualification of candidates for dignity.
The political organization entered the documentation of the businessman Álvaro Noboa and Gino Cornejo , as pre-candidates for President and Vice President of the Republic, but the CNE resolved that it would give “continuity” in the qualification of the candidates that were registered during the pertinent stage, and not new ones. .
Then, Social Justice submitted a request to the TCE to execute its sentence, the judge of first instance Arturo Cabrera, before ordering its execution, asked the Council for all the information related to the processes of internal democracy and qualification of candidates that was done with the political group.
The CNE argues that the political movement had the computer system enabled to hold its internal elections. It even registered candidates, except for national assembly members and the presidential binomial.
In the latter case, Social Justice nominated Fabricio Correa and Marcia Yazbek, but they resigned due to internal discrepancies.
On October 7, minutes before 6:00 p.m. when the system closed, they tried to enter the documentation of Carlos Cassanello and Marien Segura in their replacement, but they were unsuccessful.
Now they are waiting for the TCE to order the Electoral Council to execute the sentence to register the pair of Álvaro Noboa and Gino Cornejo.
But with the latest Cabrera resolution, the file returned to the substantiating judge (Ángel Torres) and the plenary session to adopt the pertinent decisions. (I)
