Odebrecht: Agreement points vary according to the affected country

The conditions of the negotiation are changing. The Ecuadorian prosecutor’s office has achieved the cooperation of Odebrecht in investigations for acts of corruption, implying the prosecution of officials.
This was one of the conditions required by the Brazilian company at the beginning of the year, to assist in the investigation of 11 countries in which a network for the delivery of bribes to public officials would have been rooted.
Of these countries, six have reached cooperation agreements to date. The Dominican Republic accepted this condition, according to the agreement made public and endorsed by a judge in April.
In exchange for what Odebrecht gave in its initial requirement? In the case of Ecuador, it will be difficult to know the reasons. Firday, on his arrival in Brazil, prosecutor Carlos Baca said that under the protection of the Integral Criminal Organic Code, the agreement will remain in reserve.
“In no way and under no circumstances this cooperation agreement signed with the company grants immunity to any person. No one will be immune to prosecution,” Baca said.
According to lawyer Santiago Guarderas, this change should be, in part, due to the serious situation the multinational faces not only in the country. “They could benefit from criminal laws established in cases of indictments, but in no way they will obtain immunity. Ecuadorian law provides for a reduction in punishment when there is cooperation,” he said (I).
