Case of Judge Posligua was denounced in the UN
The defense of Judge Augusto Posligua Galarza, sponsored by Jorge Zavala Egas, has denounced the trial of malfeasance of its client before the rapporteur for the independence of judges and lawyers of the United Nations (UN), Gabriela Knaul at Geneva.
Zavala requests Knaul for an urgent and public statement on Posligua’s arrest. He also asked Knaul to recommend his immediate release and his return to office as deputy Fourth Judge of Labour of Guayas.
Posligua faces trial for having partially led a protective action filed by the exporter Bananera Noboa, which temporarily halted the payment of income tax for the year 2005 to the Internal Revenue Service (SRI fot its Spanish acronym).
“The appeal exercised invoked the constitutional right to resistance,” Zavala said in its complaint.
However, the president of the Court of Justice of Guayas, Francisco Morales, considered that Posligua acted maliciously in the exercise of his functions, possibly to go against a court order to prevent granting precautionary measures to the export.
Zavala also questioned the president of the Judicial Council of Transition (CJT for its Spanish acronym), Paulo Rodriguez Molina, for having ordered Posligua’s suspension for ninety days without even knowing the judge’s “responsibility” in the alleged crime.
For these reasons, Zavala went to the Office of the UN High Commissioner on Human Rights to say they should request the national government of Ecuador for information on the Posligua Case.
Posligua is the fifth judge indicted for malfeasance in 2012.
