Colombia: Constitutional Court did not allow child adoption by homosexual couples
Colombia’s Constitutional Court denied on Wednesday the possibility that same-sex couples can adopt, but retained the option to do it when the child is the biological child of one of the two implied.
“The same-sex couples can only adopt when the request rests to the biological child of his/her permanent companion,” said the Court.
After a discussion of over nine hours, the high court ruled on the demand of a citizen against several articles of the Code of Childhood and Adolescence, construed as restrictive by the adoption of homosexual couples.
The constitutional discussion of this matter began on January 28 around a positive presentation of Judge Jorge Ivan Palacio.
However, the vote of February 4 ended tied at four votes, reason why the Court had to resort to an assistant judge to tie breaking the vote.
The decision was welcomed by some activists against egalitarian adoption who gathered outside the courthouse chanting “It´s not the same, it´s not equal, Mom and Dad adoption.”
