Constitutional Court ruled in favor of a way to proceed with the request of Rafael With You Always
On Friday April 22, seven days after the earthquake that hit Ecuador and maintains the country in emergency, the Constitutional Court (CC) published its opinion on the request made in March by the Rafael With You Always movement in order to allow the re-election of President Correa. The Court notified that the amendment shall be made through a referendum.
In the document, dated April 13, 2016, the Constitutional Court rules that the request of this group “must be processed through a constitutional amendment, in accordance with Section 441, paragraph 1 of the Constitution of the Republic.”
That point states that the amendment of the Constitution that does not alter its fundamental structure, or the nature and constituent elements of the state, that do not establish restrictions on the rights and guarantees, or that does not modify the reform process of the Constitution, will be held: through a referendum requested by the President or the citizens (as applicable in this case) with the support of 8% of those registered in the electoral registry, ie, with 928,147 signatures.
