Constitutional Court will analyze three articles of the Criminal Code
The culpable homicide for medical malpractice, the dog fights and legal liability set out in Articles 146, 250 and 49 of the Criminal Integral Organic Code (COIP) will be brought to review by the Constitutional Court.
Luis Sarrade, Spokesman of the Projusticia Médica group, said that the Court admitted to checkout his solicitation of unconstitutionality, a lawsuit in which he requests for the organism to clarify the culpable homicide, since, according to him, “it is undeniable that the target of concern in the health issue requires precise clarifications legally established”.
The Court admitted in its brief that this article, as well as those related to dogfighting and liability of legal entities need clarification and expansion.
Furthermore, today Sarrade would ask the Constitutional Court to clarify if while the constitutionality of the three items is being discussed, these are in force or not. “Because now we are in a legal vacuum,” he said.
