Gay couple in Guayaquil will present protective action

After the Civil Registry of Guayaquil refused the marriage request made by Fernando Vinces and Santiago Saltos last week, today the entity announced that the gay couples will present on December 10 a protective action in the Provincial Court of Justice of Guayas, to facilitate their marriage.
The entity denied the request, stating that to perform a civil marriage, it must meet the requirements set out in Articles 67 of the Constitution and 81 of the Civil Code, which state that “marriage is a union between a man and a woman. “
Silvia Buendia, lawyer of the couple, criticized this view and said that the two regulations did not contain requirements, but “definitions and concepts of marriage, therefore, there are no requirements that we must meet.” Also said that Article 11 Section 2 of the Constitution, indicates the feasibility of equal marriage, which states that all persons shall have equal rights and not be discriminated against on grounds of sex , gender identity or sexual orientation.
