Judge annuls first gay marriage in Colombia
Bogota’s 39th Civil Judge, Cesar Eduardo Diaz, annulled the first gay marriage performed in this country on last September 20 by his colleague Juan Carlos Ceron, 48th Municipal Judge of Bogota.
The decision was issued after the “Husband and Wife” Foundation interpose an appeal for protection against the ruling which allows such unions .
Yesterday Diaz declared null the union based on protective actions, one of them filed by the Attorney General’s Office (Public Ministry) and also for considering that this union is not provided by the Constitution.
Ariadna Tovar, legal representative of the NGO Women’s Link Worldwide, explains that the ruling, issued this October 2, on same-sex unions, corresponds to the first instance and the judgment that is being debated.” They (the couple) are still registered as married. The decision has to pass through other instances to be definitive.
After the bill on gay marriage was rejected by the Congress, which was introduced on 2011 by Senator Armando Benedetti, of the U Party , the Council of State ruled on June 20 that two people of the same sex can be a family. This led to several couples to go to court to legalize their “conjugal union” .
