Minister of Labour admits error in the legal text of retirement pensions
Yesterday the Minister of Labor, Carlos Marx Carrasco, sent the Official Gazette errata on a recital 204 of the Agreement is the employer retirement.
That agreement became public over the weekend and raised in the the sixth recital that retirement pensions shall not exceed the unified basic salary ($ 354 this year). The document mentioned what the Labour Code states, that this benefit will not be “greater than the average unified basic salary …” but added that: “… considering this as the unified basic salary.”
The agreement had caused rejection among workers from various sectors. Yesterday, the president of the Labor Ecuadorian Parliament (PLE for its Spanish acronym), Fernando Ibarra, said that besides the “illegality” would mean that a minister interprets a law as an agreement, there was no doubt about what is the average unified basic salary and the unified basic salary, since these are different things.
