Prosecutor’s Office wants to recover the $ 14.7 million in the 2012-2016 Bribery case

Within 30 days. That established the Trial Court of the Bribery case 2012-2016 , made up of   Ivan León, Marco Rodríguez and  Iván  Saquicela , so that the 20 convicted for the crime of aggravated bribery pay the reparation to the State. A repair of  $ 14.7 million , double the amount that the companies delivered in exchange for public works contracts in the Rafael Correa government .

As of Thursday, the State Attorney General’s Office (PGE) , as a victim of the criminal offense , had not received any notification from the National Court of Justice (CNJ) about compliance with the sentence by those involved .

Therefore, in the next few hours the PGE will request the CNJ court to execute the sentence. The formal announcement will be made this Friday by the head of the organization, Íñigo Salvador .

The request for execution of the sentence will be accompanied by information that the Attorney General’s Office has collected on the assets of the 20 convicted of the crime, that is, it would already have details about bank accounts, assets, shares in companies.

The information was collected in the Superintendencies of Banks , Popular and Solidarity Economy, of Companies, Securities and Insurance,  notaries ,  Property Registry at the national level, National Transit Agency ,  Financial Analysis Unit of Ecuador , INMOBILIAR , Civil Registry ,  Function judicial, DINARDAP  and  SENADI. 

With this process, the Attorney General’s Office may request the immobilization of bank accounts, the seizure of assets and their subsequent auction.

The justice found former president Rafael Correa, his former adviser Pamela Martínez, former vice president Jorge Glas, his former ministers  María de los Ángeles Duarte , Walter Solís, Vinicio Alvarado , Viviana Bonilla and Christian Viteri and nine businessmen guilty of bribery as perpetrators . Each one must pay $ 778,224.17 .

While the former assistant to the Presidency, Laura Terán, as an accomplice , will pay $ 368,632.43 and despite the fact that the businessman Alberto Hidalgo  declared himself the author of the crime, he will have to pay the same amount assigned to Terán.

Those sentenced have several options for payment . They can cancel the whole or propose a cancellation formula.

In addition, the Attorney General’s Office will request the court to order the sentenced to hold a public apology event , the publication of the sentence in three widely distributed newspapers, the placement of the plaque at the Carondelet Palace  and attendance and accreditation of the ethics course and transparency in public administration. 

This will be considered separately from the criminal sphere and does not exempt them from the eight-year prison sentence that most of them received.
