Regulation of capital gains could be included in Land Use Law
The debate on the elimination or regulation of the capital gains of land could get ahead in the Assembly with the processing of the Zoning and Land Use Law, without making a change to the Constitution.
This is one of the reforms that Alianza PAIS (AP) left out of the first ‘package’ of amendments, with the possibility of including it in the second. However, the block does not exclude that in the same Zoning regulation draft a regulation is reached to be then “rised to the Constitution.”
The legislation draft states that public works projects that generate capital gains in lots of its environment may demand a share of this. It also mentions that public participation in the capital gains would go up to 25% and owners can choose between paying it in cash or to give buildable land to municipal administration.
