The Court rejected the request for annulment in the Cofiec case
The request for annulment was unsuccessful in the National Court. The defense of Pedro Delgado, Francisco Endara and Antonio Buñay wanted to tear down the sentence against them.
After two hours of hearing, the Court of the Criminal Chamber, chaired by Associate Judge Edgar Flores, rejected the appeal. They were sentenced as perpetrators of bank embezzlement in the so-called Cofiec case.
Lolita Montoya, Lorena Grillo and Juan Carlos Leon, lawyers of the convicted, said that the decision had no reasons, there was not a report of the Comptroller to start the trial, and the Prosecution shouldn´t have initiated a criminal process, but a civil action.
Prosecutor Galo Chiriboga said that the decision of the judges, that was notified in April, contains more than 241 pages of context to support the resolution. The court agreed with that criteria to reject the appeal.
Delgado, Endara, Bunay and five other people were sentenced for participating in the granting of a loan for $ 800,000 from the Cofiec Bank to the Argentine citizen Gaston Duzac without the necessary guarantees.
From 14:00, the court had to resolve the appeals to the judgment submitted by the six convicted.
